These Terms and Conditions (“Terms”) are entered into by and between GolfGeeks LLC (“Golf Geeks,” “we,” “us,” or “our”) and the user, member, guest, or customer accessing or using the Golf Geeks website, mobile application, physical facility, and all related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
By checking any acceptance box, clicking any assent button, signing digitally, or proceeding with a membership purchase, booking, or facility access workflow, you agree that such action constitutes your electronic signature and your legally binding acceptance of the applicable terms, policies, waivers, and notices.
1. Eligibility & Accounts
You must be at least 18 years of age to create an account, purchase a membership, or make a booking at GolfGeeks LLC. Any person under eighteen (18) years of age may access or use the facility only under the supervision and responsibility of a parent or legal guardian who has executed the required consent, release, and indemnity documentation on the minor’s behalf. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Memberships
GolfGeeks LLC offers various membership tiers, each with specific benefits, limitations, and pricing as described on our Memberships page. By purchasing a membership, you agree to the following:
- Memberships are personal and non-transferable. Only the named member may use membership benefits.
- Membership fees are billed on a recurring monthly basis on the date of purchase unless otherwise stated.
- Annual memberships are billed as a single payment and are non-refundable once the membership period has begun.
- GolfGeeks LLC reserves the right to modify membership pricing, benefits, or tiers with 30 days’ written notice to active members.
- Members are responsible for ensuring their payment information is current and accurate.
3. Bookings & Reservations
- All simulator bookings must be made through our online booking system.
- Booking availability is subject to your membership tier and current availability.
- Bookings begin and end at the scheduled time. Late arrivals will not receive extended time.
- You must vacate the simulator bay promptly at the end of your booked session.
- GolfGeeks LLC reserves the right to cancel or reschedule bookings due to maintenance, emergencies, or other unforeseen circumstances. In such cases, affected members or guests will be notified and offered a rescheduled booking at no additional cost.
4. Cancellation & No-Show Policy
Bookings may be cancelled or rescheduled only in accordance with GolfGeeks LLC’s then-current cancellation policy as presented at the time of booking. Any eligible refund, credit, rescheduling option, late-cancellation fee, or no-show charge shall be determined in accordance with that policy and applied consistently to all reservations.
- Reservations cancelled at least 2 hours before the scheduled tee time may be rescheduled or refunded in full.
- Reservations cancelled within 2 hours of the scheduled start time may be rescheduled or will incur a 50% cancellation fee.
- Failure to arrive for your reservation without notice will result in 100% of the booking fee being charged. Repeated no-shows may result in account action: 3 no-shows – you will be contacted regarding the missed reservations; 4 no-shows – your account will be flagged; 5 no-shows – your account will be suspended until the next billing cycle.
- Large group bookings, events, or bay buyouts require 48 hours’ notice for cancellations or rescheduling.
5. Facility Use & Code of Conduct
All visitors, members, and guests are expected to conduct themselves in a respectful and responsible manner while at GolfGeeks LLC. The following rules apply:
- Use all simulator equipment, screens, sensors, and furnishings with care and in accordance with posted instructions.
- No abusive, threatening, or disruptive behavior toward staff, members, or guests.
- Appropriate attire and golf-appropriate footwear are required at all times. No cleats, spikes, or open-toed shoes in simulator bays.
- If you bring your own clubs, please ensure club faces are clean before play.
- Children must be supervised by a parent or guardian at all times.
- No outside food is permitted. Beverages from outside the facility are not allowed when our bar is in service.
- Smoking, vaping, and the use of illegal substances are strictly prohibited inside the facility.
- GolfGeeks LLC reserves the right to refuse service or revoke access to any individual who violates these rules, without refund.
Simulator Bay Rules
- No swinging clubs outside of the simulator hitting bay.
- Only one person in the hitting bay area at a time.
- Before you swing any club, check your surroundings (monitor, other players, etc.) to ensure no one or obstacle is within your range of swing.
- Be aware of your backswing and follow-through at all times.
- Your shot must be directed forward toward the screen.
- Swinging should always take place on the hitting area of the mat.
- Practice swings must be done on the hitting area of the mat.
- Be alert of where you stand or walk and stay out of someone’s range of swing.
- There are uneven surfaces that are a tripping hazard – watch your step.
6. Assumption of Risk & Liability Waiver
Golf is a physical activity that carries inherent risks, including but not limited to muscle strain, joint injury, and impact from golf balls or equipment. By using our Services, you acknowledge and voluntarily assume all risks associated with participating in golf-related activities at our facility.
To the fullest extent permitted by Texas law, you agree to release, discharge, and hold harmless GolfGeeks LLC, its owners, officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to your use of our facility and Services, except in cases of gross negligence or willful misconduct by GolfGeeks LLC.
You acknowledge that during unstaffed hours, no medical or supervisory personnel are on-site. You assume all risks associated with using the facility with or without staff present. For all emergencies, call 911.
Note: A separate Adult Waiver and Release, and a Minor Waiver and Parent/Guardian Consent form, are required for all participants. These documents must be executed during the booking and facility entry process.
7. Property Damage
Customers are responsible for damage to GolfGeeks LLC property caused by their negligence, misuse, intentional conduct, or the negligence, misuse, or intentional conduct of their guests, including but not limited to simulator screens, projectors, sensors, flooring, furnishings, and any other facility property. GolfGeeks LLC may charge the payment method on file for documented repair or replacement costs after providing notice of the charge and, upon request, reasonable supporting detail.
Pre-Session Inspection: Customers should promptly report any visible bay or equipment issue at the beginning of the session. Reports may be made to staff (when present), by calling 469-319-0109, or by emailing hello@golfgeeks.com within the first 5 minutes of your session. Failure to report an apparent condition within this initial inspection window may be considered in evaluating whether the condition existed at the start of the booking.
8. Alcohol & Conduct Policy
- TABC Compliance: Alcohol is served only during designated hours by a TABC-licensed staff member. Outside alcohol is strictly prohibited at all times. Customers found in violation of this rule will be removed from the premises and will forfeit their scheduled session without refund.
- Mandatory Cessation: Once the licensed bar service concludes for the day, all alcohol consumption on the premises must cease immediately, regardless of remaining simulator time.
- GolfGeeks LLC reserves the right to refuse service or revoke facility access to any guest who appears impaired, behaves unsafely, or violates any house rules. This includes remote deactivation of simulators and revocation of building access without refund.
9. Guest Policy
- Members may bring guests in accordance with their membership tier’s guest allowance.
- The person booking the session (Primary Member) assumes full legal and financial responsibility for all guests.
- The Primary Member agrees to be liable for any damages or injuries caused by or to their guests.
- The Primary Member is responsible for ensuring all guests are registered or have signed the required digital waivers prior to entry.
- The Primary Member agrees to indemnify GolfGeeks LLC against any claims brought by their guests.
- Guests must comply with all facility rules and these Terms.
- Guest access is subject to availability and may be restricted during peak hours or special events.
10. Automated Access & Security
GolfGeeks LLC uses automated door access systems 24/7. By booking a session, you agree that:
- You will not share your access credentials, door codes, or digital keys with anyone.
- You will not allow unauthorized individuals to enter the facility using your access.
- You will ensure the door is securely closed when entering and exiting. Do not allow tailgating – incoming guests must access the building with their own unique access code.
For safety, security, and insurance-support purposes, GolfGeeks LLC uses security cameras and automated entry logs within or around the facility. Related recordings and access records may be reviewed, retained, and disclosed as reasonably necessary for safety, incident response, insurance, legal compliance, and protection of the company, its staff, and its customers. By entering the facility, you consent to being recorded for these purposes.
Exit Checklist
To avoid a $50 cleaning fee, please complete these steps before your time expires:
- Clear the floor: Return all golf balls to designated trays.
- Trash: Dispose of all trash.
- Software: Close your session on the simulator screen.
- Check for all personal items and ensure the door is locked and latched when exiting the building.
11. Payment Authorization
By purchasing a membership, reserving a booking, or maintaining a payment method on file, you authorize GolfGeeks LLC to charge the payment method on file for all valid amounts due, including membership fees, booking fees, taxes, approved event charges, late-cancellation fees, no-show fees, cleaning fees, and documented damage or repair charges arising from your use of the facility or the use of the facility by your guests.
12. Intellectual Property
All content on the GolfGeeks LLC website and application, including text, graphics, logos, images, software, and design, is the property of GolfGeeks LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
13. Limitation of Liability
To the maximum extent permitted by applicable Texas law, GolfGeeks LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, including but not limited to lost profits, lost data, personal injury, or property damage, regardless of the theory of liability.
In no event shall GolfGeeks LLC’s total liability exceed the amount you paid to GolfGeeks LLC in the twelve (12) months preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless GolfGeeks LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your violation of these Terms, your use of the facility, or your negligent or wrongful conduct.
15. Dispute Resolution
Any disputes arising out of or relating to these Terms or your use of GolfGeeks LLC’s Services shall be governed by the laws of the State of Texas, without regard to conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Ellis County, Texas, and you consent to the personal jurisdiction of such courts.
16. Termination
GolfGeeks LLC reserves the right to suspend or terminate your account, membership, or access to our Services at any time, with or without cause, and with or without notice. In the event of termination for cause (e.g., violation of these Terms, facility damage, or abusive behavior), no refund of prepaid fees will be issued. In the event of termination without cause, a prorated refund of prepaid membership fees may be issued at GolfGeeks LLC’s discretion.
17. Modifications to Terms
GolfGeeks LLC reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and Payment Policy, constitute the entire agreement between you and GolfGeeks LLC regarding your use of our Services and supersede all prior agreements and understandings.
